We (parents) had applied for family based concurrent AOS in Aug, 2008 while we were on
tourist visas. We are now in India on Advance Parole(valid till Aug. 2009) that we received
after filing AOS.
Today(Feb, 2009) production of green card has been ordered for my wife and will soon be
received in USA. My case is still pending but we expect it processed soon. Thanks for all
the help.
My questions is
(a) What documents we need to show at immigration on returning to USA?. We have I-485
Notice, Advance Parole and valid Passports.
(b) Do we need to request somone in USA to mail our green cards on receipt.?
(c) How much maximum time we still can stay in India.? We wish to stay here for another 1-2
months. In any case making travel arrangements etc. is likely to take atleast 2 weeks.
(d) But is there a time limit for returning?
(e) Can we safely enter 2-3 months after the cards are received in USA, and
(f) sending GC by mail is not objectionable?
Also, in totality, Which one of these scenarios is correct:

2) It means if we can get our cards mailed and receive it here, we can safely travel back

I think any non-H1 (including H4) stay wont count. You will have full 6 yrs on H1 visa.
This is wrong. If you go out of USA and come back after a gap of 1 year, then only u will get full 6 years. Other wise whatever your status is ( as L1, B1 etc ) that will count into H1 period

I am also in the same boat as you and my attorney has sent my Labor ETA 750 to DOL for changing the box 15. It is good to change it now at Labor stage as there is quite lot rejection at I140 stage if your degree is 3 years..so it is better to have it ammended at Labor stage.
I would say all those who are waiting on Labor with 3 Years degree should make sure that your Labor states that it a "combination" else you will be trouble.

My husband is the primary and got his GC in July last year, under EB2. Upon suggestion, from my lawyer, I have made 1 info pass appointment (Oct 07) and raised 4 service tickets till now. All say they are processing.
My priority date is Aug 05. Now that the priority dates have moved. I have put one more service ticket but do not know what will happen. Upon again contacting my lawyer, suggested me to contact Congressman / Senator.
Anyone in the same pool ? Any suggestions ? I am in Pennsylvania state (Chester County).

I got married recently. Both my husband and I have similar priority dates as labour was filed separately for each of us by our respective companies. Is there any downside to adding each other to our applications and dual filing for greencard?

It is ok to have gap between AP renewals even when you are using EAD as work authorization. You are ok if did not apply for AP during the entire I-485 wait time, even if you are using EAD or used AC21 to change employer. You need valid AP only on the day you leave US, period of stay outside of US and the date you enter back into US when waiting for I-485 approval. In the same manner, you need not even apply for EAD if you do not plan to use EAD card or the gaps between EAD period is also ok as long as you are not using EAD as your work authorization, and you have other work authorization like valid H1/J1.
EAD & AP are just like Add-ons to your computer. They are not mandatory, but you definately want them at the time you want to use them.

That is correct.. any stay on "H" (H1, H4) or any "L" (L1, L2) will count towards 6 years.

I'm wondering if criminal charges that never lead to a conviction (3 charges in total) can cause a green card holder to get deported? Also, when a person applies to renew a green card after it expired will another FBI fingerprint check be done?

If you were never convicted, you should not have any problems. Because remember, you are innocent until proven guilty ( which means conviction) and being charged is not an offense by itself. You might face some problems at POE because your finger prints might show up due to arrest record, but if you have court documents showing you were acquited or police documents showing that your charges were dropped, you should be OK.

What type of phone do you have that has that kind of image quality?
Exif data shows:
HTC - MDA_compact_IV .. which is the Tmobile name for the HTC Diamond :P.
It has a 3.2 megapixel camera. I do however believe that it doesnt really matter what camera you use, if you cant make good pictures with a pocket camera then a $2000 camera wont help either ;)

We recently moved our place and we are now in a new apartment.

Hi All,
A few questions for those who have experience with registering a sole prop. in the US.
My wife is on an H4 visa and has registered a sole prop. earlier this year. Since she is not eligible to work, she has hired a U.S. citizen as a contractor to run the company.
Does owning a company in the US have any impact on our green card application?
Can she draw profits from the company at the end of the year as a return on the investment she made to start the company?
Is she considered a "U.S. person" ( seen in multiple tax forms )?
Is it safe for her to fill out a W-9 form with the FEIN that the company was registered with?

Hi-
I am applying for my EAD/AP renewal. The received date on my I-485 notice is Aug 2007. According to USCIS, if you filed after July 30 2007, you are not required to include a Fee.
I am looking at my receipt notices and I feel like I payed under the old fee structure and should include the fee. Here are the amounts
I-485 : $395.00
I-765 : $180.00
I-131: $170.00
Can someone please advice if I need to include the fee for AP and EAD renewal.

I remember reading if you travel outside the country while your AP is pending, it will be considered abandoned and you may not receive approval or any refund.

This is unfortunately a little incorrect advise. H1B is a dual intent visa, which means it can be held TOGETHER with your AOS or 485.
As long as you use your H1B to travel, you are fine.

Your H1 will come under the annual 65,000 H1 cap, as you might know the cap of this year is already over, you can apply for this COS come April 1 2008 and you can start working October 1 2008 with your H1. Please note you CANNOT start working for a new employer by just receiving a receipt number for your COS. You will need to get the actual H1-B approval notice. While applying for the COS you will also need to show you are currently employed and this can be done by submitting two most recent pay checks along with your other papers. Hope this helps!!
